MAGIX Soundpool DVD Collection 19 is a library of over 6000.

I have seen simular questions to this but not exactly the answer I was looking for. There is a lot of confusion over the rights and useage of the Sound Pools. I will give a full outlook on why I am asking this question. I have called and spoken to someone at Magix, I have also been emailing them but no clear answers.

What doesnt make sense is, why include a disk of loops and sounds, if you cant use them in the music you write to sell online? So anyway, here are my facts: I have Magix Music maker 2013 Premium I also purchased the DVD Sound Pool Collection 19.

I have created a music album of my compositions. On some of the songs, I have used a drum loop or other Looping instrument. I am being told by Magix that I cannot sell my music unless I pay $199 U.S for a professional License.

Line 6 of the EULA on the DVD collection 19 disk reads: 6. USE OF MUSIC, VIDEO AND PHOTO FILES: The music, video and photo files included with MAGIX products may only be used within the scope of producing personally created works to be used for commercial purposes. This also applies to music, video or photo data acquired through or by means of MAGIX products.

Commercial use constitutes receipt of financial benefits through direct or indirect use of the files (through sale, licensing, ad banners, etc.) This applies to the music, video and photo files included with the product 'WebDesigner' with the stipulation that these files may be used in the scope of the purchaser's own commercial website. Transfer of these files to third parties for commercial purposes is not permitted.

Exploitation of these music, video and photo files outside the scope of personally created works is illegal. Exploitation of these music, video and photo files outside the scope of personally created works is prohibited.

Have I misunderstood this? Because from what I understand I have used the sound within the scope of producing my music for commercial purposes. I understand you cannot extract the loops and sell them to third parties as single files. I believe I used them and I dont feel I need to pay $199 for a professional license. Why would they sell me the disk if I have to pay addional for a professional licence to use it for the purpose of oringinally buying the disk in the first place?? Who is going to write music just for Youtube???

On the Protools Music program. You are free to use their loops on your music and to sell commercially, but I do not understand why this is different? Can someone please clear this up and explain why the EULA is different than what Im being told by Magix.or Catooh.

If this gets to be too complicated perhaps I should of saved up a little more for Pro-tools. Hi, Go into Catooh and check the licenses that you have. To use any of the prerecorded loops, you need the professional license.

Magix sells the program with loops, sounds, photos, etc. For personal use, not professional use at a low price. If you want to use any of them commercially, then you have to pay more to get the professional license.

When you are purchasing loops, there are some out there that are free, and some are royalty-free, but not free to purchase. Look at SonicFire to see how much they charge for their songs. I can use them, or even just a piece that the program modifies to suit my taste and length, commercially because that is the license that is purchased.

They don't make any distinction between personal and commercial, you pay, a lot. Magix, on the other hand, allows you to obtain a lot for a very low price. If you decide to use any of it commercially, then you pay extra. If you don't use some or any of it commercially, but only privately, then you didn't have to pay for the pro license.

Sounds fair and great to me. I have Soundpool DVD Collection 20 and I checked all of the English licenses, and they all say: 'The music, video and photo files included with MAGIX products may only be used within the scope of producing personally created works to be used for non-commercial purposes. This also applies to music, video or photo data acquired through or by means of MAGIX products. Commercial use constitutes receipt of financial benefits through direct or indirect use of the files (through sale, licensing, ad banners, etc.) This applies to the music, video and photo files included with the product 'WebDesigner', 'Web Designer Premium' and 'Photo & Graphic Designer' with the stipulation that these files may be used in the scope of the purchaser's own commercial website.

Transfer of these files to third parties for commercial purposes is not permitted. Exploitation of these music, video and photo files outside the scope of personally created works is illegal. Exploitation of these music, video and photo files outside the scope of personally created works is prohibited.' Does yours really say ' for commercial' and not for ' non-commercial' purposes?

If so, then you had better show that 'error' to Magix. On the Catooh site, it is pretty obvious the license that one is purchasing. Click on the licenses to get more details. Log in to Catooh and check your licenses. I have some Pro licenses that I didn't even know I had.

I copied and pasted exactly what the EULA had that was on the disk itself. It was the English version. And I pasted Line 6.there was no additional editing. The deficiency must be redressed within a reasonable period, which may also be effected - at the discretion of MAGIX - through an appropriate replacement of the product or program version with a comparable performance scope. This does not include times in which the server is not available over the Internet due to technical or other problems not under the sphere of influence of MAGIX (force majeure, third party defaults, etc.). MAGIX explicitly does not vouch that the conditions outside the software are available at all times and are indelible. MAGIX will however, attempt to ensure that the connection service is provided for the duration for the reasonably expected software usage (life cycle), or at least four years following the customer's purchase of the license. MAGIX can temporarily limit or block access to the services, as long as this is to provide public safety, network safety, maintenance of network integrity and improved interoperability of the service, data protection, to counter spam or computer viruses or to render operationally or technically necessary services.

The aforementioned limitations are exempt when calculating the stated service availability. Place of performance for delivery purposes in Europe is Berlin. The contract is subject to the laws of the Federal Republic of Germany. My Soundpool DVD Collection 20 is on a DVD that I received with MMM2014 or MEP, I believe. It is not even registered, whereas the others were downloads, some that came bundled with MMM or Samplitude Music Studio and a serial number. When I registered the latter, the license came up in some cases as Pro. I suggest that you take this up with Magix/Catooh as there is a difference in what you received. If it is their 'error' then they will have to make good on what the license says.

Try reasoning with them, as lawyers cost more than the soundpools. My Soundpool DVD Collection 20 is on a DVD that I received with MMM2014 or MEP, I believe.
